Object – These general terms and conditions govern the use of Tuduu, a mobile application owned by Drilldown s.r.l., based in Milan, viale Isonzo n. 8, C.F./P.I. 12392590969 (hereinafter, "Drilldown").
Description – Tuduu allows you to: (1) create shopping lists of food and consumer products drawing from a database of Drilldown fed with information from producers; (2) obtain, in real-time and for each individual product, an indicative price estimate based on average market values, nutritional information, and ingredients of food products; (3) check in real-time the compatibility of each individual product with dietary restrictions, personal choices, tastes, and lifestyles set by the user in the nutritional profile (hereinafter, "Nutri-alert"); (4) share the shopping list in digital format with other users through the most common social media.
Registration to Tuduu – The use of Tuduu is free. The application can be downloaded through the Apple App Store or Google Play Store. Creating the access account for Tuduu takes place (1) by filling out a registration form and sending the registered user (hereinafter, "User") personal authentication credentials or (2) through the social network used by the User. The User: (1) declares and warrants that they are of legal age and provide truthful and correct data; (2) keeps the authentication credentials confidential and does not make them available to third parties; (3) undertakes to promptly communicate any unauthorized use of their authentication credentials that they become aware of. Drilldown reserves the right to suspend the use of Tuduu if there are valid reasons to believe that Tuduu is being used by minors or unauthorized third parties. Drilldown is not responsible for the consequences arising from unauthorized accesses to Tuduu that depend on the negligent use of authentication credentials by the User.
Service Features – The User can access Tuduu at any time and use the functionalities, as made available through the application from time to time. Drilldown reserves the right to temporarily suspend the service for maintenance, updates, and security reasons, and assumes no responsibility towards the User or third parties for the consequences arising from the suspension of Tuduu or any access difficulties. Drilldown commits to periodically update product information in the database and information about associated merchants but assumes no responsibility for the completeness and reliability of the information provided through Tuduu. The Nutri-alert service is exclusively informational and does not constitute, nor can it be interpreted as, medical, dietary, or nutritional advice, so the User is required to exercise normal caution in purchasing and consumption decisions.
Use of Tuduu – The User can use Tuduu exclusively for private use, for the purposes provided by these general conditions and under the terms expressly indicated in the application and on the site. Without written consent from Drilldown, the User is prohibited from: (1) using Tuduu and its content for purposes other than those intended; (2) taking initiatives that could prevent, compromise, or disturb the proper functioning of Tuduu. Drilldown is not responsible for the consequences arising from improper and unauthorized use of Tuduu by the User. The User undertakes to indemnify and hold Drilldown harmless from any liability and from any compensation obligation arising from improper and unauthorized use of Tuduu.
Intellectual Property Rights – The registration and use of Tuduu do not confer any rights over the software, trademarks, and content of Tuduu, including its graphic and design elements, which are the exclusive property of Drilldown, nor over the images and descriptions of products, which belong to their respective owners and may be protected by trademarks, patents, or copyrights. Without written consent from Drilldown, the User is prohibited from: (1) copying, decompiling, modifying Tuduu or performing any other activity aimed at obtaining the source code of the application; (2) copying, storing, reproducing, reworking, transmitting, distributing, or publishing in any medium or support the content and information present on Tuduu; (3) marketing and distributing Tuduu as an agent, reseller, or dealer of Drilldown or in any other capacity.
Newsletter – By accepting these terms at the time of registration, the User consents to Drilldown srl collecting the email address in order to send communications (opt-in). The User has the right to unsubscribe at any time from the informational communications that Drilldown srl will periodically send.
Right of Withdrawaland Service Suspension – The User always has the right to uninstall Tuduu and cease its use. Drilldown reserves the right to discontinue the service offered via Tuduu with at least 7 (seven) days' notice. Without prejudice to any other legal remedy, Drilldown reserves the right to suspend the service with immediate effect in case of violation by the User of the provisions of these general conditions or if the User is involved, in any capacity, in a dispute that directly or indirectly involves Tuduu.
Modifications – Tuduu is characterized by continuously evolving technology. Drilldown reserves the right to update the technical and economic features of Tuduu at any time. Any changes to these general conditions will take effect 10 (ten) days after communication to the User.
Complaint Management – Any complaints regarding the use of Tuduu are to be sent to Drilldown at the address info@tuduu.it. Drilldown reserves the right to review the complaint and provide a written response.
Privacy Policy – Drilldown processes the personal data of the User in compliance with privacy legislation and under the terms indicated in the specific information available on the site.
Applicable Law and Jurisdiction – These general conditions are governed by Italian law. Without prejudice to the provisions of the Consumer Code, any disputes regarding the interpretation and execution of these general conditions are referred to the Court of Milan.
